Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MissionPay platform, including the website at missionpay.com.au, the donor and organisation admin portals, embeddable giving widgets, mobile applications, and related APIs (together, the "Service"), operated by MissionPay (the "Company", "we", "us"). By creating an account, accepting an invitation, or making a donation through the Service, you ("you", "User") agree to these Terms.
1. Who can use MissionPay
MissionPay is built for organisations and businesses and the donors/customers who support them. To use the Service you must be at least 18 years old and legally able to enter into a binding contract under Australian law. By registering as an Organisation Admin you confirm that you are authorised to act on behalf of the registered organisation you represent.
2. Account types and eligibility
Donors
Donors/Customers may create a registered account or give as a guest. You agree to provide accurate contact and payment information and to keep your credentials secure. You are responsible for activity carried out under your account.
Organisation Admins
Organisation Admins create and manage an organisation profile, configure giving funds and campaigns, accept donations, and manage other admins for that organisation. By signing up as an Organisation Admin you confirm that the organisation you represent is a legitimate business and/or charitable, religious, or not-for-profit organisation operating in Australia, New Zealand or another supported country, and that you will provide accurate information for compliance and payout purposes (including tax IDs such as ABN where applicable).
Approval
New organisation accounts require platform approval before they can accept donations, make transactions and use the MissionPay platform. We may refuse, suspend, or terminate any account at our discretion if we believe the organisation does not meet our eligibility criteria, has provided inaccurate information, or poses a risk to donors, payment processors, or the Service.
3. Payments and Stripe Connect
MissionPay uses Stripe (Stripe Payments Australia Pty Ltd and its affiliates) as its payment processor. By using the Service to send or receive payments you also agree to Stripe's Connected Account Agreement (for organisations) and the Stripe Services Agreement (for donors).
Donations/transactions are settled directly to an organisation's connected Stripe account. MissionPay does not hold or transmit donor funds; we facilitate the connection and record the transaction. Payouts, payout schedules, and any holds, refunds or chargebacks are governed by Stripe's terms and the organisation's Stripe configuration.
4. Fees
MissionPay charges a platform fee on each donation, in addition to Stripe's own processing fees. The current platform fee is configurable per organisation and is displayed at the point of donation. Whether the donor or the organisation bears the fees depends on the organisation's setting (donor pays, organisation absorbs, or donor chooses) — this is shown to the donor before payment.
The fee is subject to change. Material fee changes will be notified to Organisation Admins by email at least 14 days before they take effect.
Payments with Purpose. MissionPay donates 10% of net platform revenue to charity. This is a current practice rather than a contractual commitment — we may change the percentage, the recipient causes, or discontinue the programme at our discretion, and any change will be reflected on our marketing pages.
5. Tax receipts
Tax receipts are generated automatically for donations made to funds that the organisation has flagged as tax-deductible (typically DGR Item 1 or 2 status under the Australian Income Tax Assessment Act). The accuracy of the organisation's configuration — including DGR status, ABN, and the tax-deductibility flag on each fund — is the responsibility of the organisation. MissionPay generates and delivers receipts based on that configuration but does not provide tax advice.
6. Refunds and chargebacks
Donations are generally non-refundable. A church may request a refund through Stripe within the period and rules permitted by Stripe. If a chargeback is raised by the donor's card issuer, the disputed amount and any associated chargeback fee will be deducted from the organisation's Stripe balance per Stripe's terms. MissionPay does not act as arbiter of refund disputes between donors/customers and organisations.
7. Acceptable use
You agree not to:
- use the Service for fraudulent, illegal, or deceptive purposes;
- solicit donations on behalf of an organisation you are not authorised to represent;
- misrepresent the tax-deductibility of donations or the use of donated funds;
- upload content that is unlawful, defamatory, infringing, malicious, or harmful;
- attempt to circumvent platform fees, bypass approval workflows, or impersonate other users;
- probe, scan, reverse-engineer, or otherwise interfere with the security of the Service;
- use automated tools to scrape donor or church data beyond what our APIs explicitly allow.
Suspected violations may result in immediate suspension and, where required, reporting to law enforcement or financial regulators.
8. Two-factor authentication
Organisation Admins are required to set up two-factor authentication once their organisation is connected to Stripe. We provide a 24-hour grace period after first connection to complete setup. After that, sign-in to admin areas requires a second factor (an authenticator app or a passkey). We may require additional verification steps at our discretion to protect the Service.
9. Your content and intellectual property
Organisations retain ownership of the content they upload (logos, branding, hero images, fund descriptions, campaign content). You grant MissionPay a worldwide, non-exclusive, royalty-free licence to host, display, transmit, and back up that content for the purpose of operating the Service.
MissionPay retains all rights in the Service itself, including the platform software, design, and trademarks.
10. Service availability and changes
We aim for high availability but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue any feature of the Service at any time. We will provide reasonable advance notice of material changes that affect Organisation Admin functionality.
11. Termination
You may close your donor or organisation admin account at any time via the in-app settings or by contacting support. We may suspend or terminate your account if you breach these Terms, provide false information, or if your continued use of the Service exposes us, our payment processors, or other users to legal, financial, or reputational risk.
On termination of an organisation account, donations made before termination remain on the platform and continue to settle via Stripe per the organisation's existing payout configuration. Tax receipts already issued remain valid.
12. Data, privacy and retention
Our handling of personal information is described in our Privacy Policy and, for churches who process donor information through MissionPay, our Data Processing terms.
Financial records (donations, transactions, tax receipts) are retained for at least seven years to satisfy Australian Taxation Office and corporate record-keeping obligations. Personal information attached to those records can be scrubbed at the donor's request via our right-to-erasure flow; the financial fact remains, but identifying information is removed.
13. Disclaimers and limitation of liability
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by Australian law, MissionPay disclaims all warranties not expressly set out in these Terms, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.
Subject to the above, MissionPay's total liability to you for any claim arising out of or relating to the Service is limited to the greater of (a) the platform fees you have paid us in the 12 months immediately before the claim, or (b) AUD 100. We are not liable for indirect, incidental, special, consequential or punitive damages, including loss of donations, loss of reputation, or loss of data, except where such liability cannot be excluded by law.
14. Indemnity
You agree to indemnify and hold MissionPay harmless from any claim, damage, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your misrepresentation of an organisation's status, your misuse of donor data, or your violation of any applicable law or third-party right.
15. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent change. Continued use of the Service after a change constitutes acceptance of the updated Terms. Material changes that affect Organisation Admin functionality will be notified by email.
We reserve the right to change, modify, or discontinue any provision of the Service or these Terms at our discretion.
16. Governing law
These Terms are governed by the laws of Victoria, Australia. Disputes will be resolved in the courts of Victoria unless required otherwise by a non-excludable consumer protection law.
